TRASH DASH BY CLEAN AF
Trash Removal Service Agreement & Terms of Service
Version 2026-10-27b
This Trash Removal Service Agreement ("Agreement") is entered into between Trash Dash by Clean AF ("Company") and the undersigned customer or property management company ("Customer").
By accepting this Agreement, Customer acknowledges and agrees to the following terms and conditions.
1. Scope of Services
Trash Dash provides scheduled and on-demand bagged trash removal services for vacation rental properties and other approved residential properties.
Service may be scheduled following guest checkouts or requested as needed.
Collection locations are established by Company during the initial setup visit and communicated to Customer.
Trash may be collected from inside or outside the property, provided safe and authorized access is available.
Service includes collection and disposal of up to six (6) standard household trash bags per scheduled pickup. Standard is defined as 13-gallon kitchen trash bags.
Trash Dash reserves the right to refuse unsafe, prohibited, excessive, or improperly prepared waste.
Service does not include general housekeeping, property cleaning, hazardous waste removal, construction debris, or cleanup of scattered trash unless separately agreed upon.
2. Trash Bag Limits
Each scheduled pickup includes a maximum of six (6) standard household trash bags. Standard is defined as 13-gallon kitchen trash bags.
Because of wildlife activity in the Angel Fire area, Company will generally collect bags exceeding this allowance rather than leave them at the property. Customer will be notified on the pickup confirmation when a pickup exceeded the allowance.
Repeated or substantial overages may require a revised service plan, additional pickups, or adjusted pricing, which will be discussed with Customer before any change takes effect.
All trash must be securely bagged and tied before pickup.
Company may decline to collect loose, unbagged, overflowing, or improperly prepared trash at its discretion.
Cleanup beyond the services expressly agreed upon is the responsibility of the Customer, not Company.
3. Property Access Requirements
Customer is responsible for providing accurate and current access instructions, including door codes, alarm codes, gate codes, lockbox information, and approved trash collection locations.
If Company arrives for a scheduled pickup and cannot access the property or designated trash collection area due to incorrect codes, locked doors, inaccessible gates, dead batteries on the door lock, or other access restrictions, or if no trash is present at the designated collection area at the time of a scheduled pickup:
- The pickup may be marked unsuccessful.
- A $10.00 unsuccessful pickup fee will apply.
- A return visit is not guaranteed, must be separately scheduled, and may require an additional service charge.
Customer must notify Company promptly of changes to property access information.
4. Winter Weather & Safe Access
Customer is responsible for maintaining safe access to the property and designated trash collection area.
This includes:
- Driveways must be reasonably cleared of snow and accessible because Company will not park on the street.
- Sidewalks and walking paths shoveled and reasonably free of ice.
- Stairs, decks, and entryways maintained in safe condition.
- Gates and access points accessible and operational.
If Company determines that snow, ice, inadequate plowing, blocked walkways, or other hazardous conditions make access unsafe, employees will not be required to perform the pickup.
A $10.00 unsuccessful pickup fee will apply when Company arrives for a scheduled service but cannot safely access the property.
Company reserves the right to refuse service whenever conditions present a reasonable safety concern.
5. Wildlife, Scattered Trash & Property Conditions
Due to the presence of wildlife in the Angel Fire area, Customer is responsible for ensuring trash is properly secured before pickup.
Company is not responsible for:
- Trash scattered by bears, raccoons, birds, or other wildlife.
- Trash bags torn open before Company arrives.
- Cleanup of garbage spread across yards, decks, driveways, or surrounding areas.
- Damage caused by wildlife accessing trash before or after a scheduled pickup.
- Overflowing or unsecured trash containers.
Trash Dash is not obligated to gather, rebag, or clean up trash scattered by wildlife.
If cleanup is requested, Company may offer additional services at a separately approved charge.
6. Setup Visit, Designated Collection Area & Company Materials
Service begins with a one-time setup visit. During this visit Company verifies that the provided access information is accurate and functional, establishes the designated area where guests leave trash and where Company collects it, and provides Customer with a photograph of the designated area and suggested guest-book wording.
Company may place identifying materials at the designated collection area, which may include signage, a placard, a QR code, floor markings, or trays.
Any materials placed by Company remain the property of Trash Dash by Clean AF.
Customer is responsible for keeping the designated collection area accessible, usable, and free of obstruction, and for not relocating or removing Company materials without notifying Company.
Customer must notify Company if Company materials are missing, damaged, or removed. Replacement costs may apply for materials lost or damaged beyond normal wear and tear.
Upon termination of service, Company may retrieve its materials from the property, and Customer agrees to provide reasonable access for retrieval.
7. Pricing, Billing & Payment Authorization
Service pricing will be established separately based on the selected service plan, property location, and anticipated service volume.
A one-time setup and verification fee is charged at signup for each property.
Property management companies may qualify for volume-based pricing.
Billing Terms:
- A valid credit card on file is required to establish and maintain service, except as provided below for property management accounts.
- Invoices are issued at the beginning of each month for the pickups and charges from the prior calendar month (property management accounts approved for invoiced billing are invoiced as described below).
- Monthly invoices include all services performed during that calendar month, including applicable unsuccessful pickup fees and other agreed fees.
- Customer authorizes Company to charge the card on file for the invoiced amount on the billing date.
- Customer is responsible for keeping payment information current.
- Declined payments or expired cards may result in suspension of future services until the account is brought current.
- Customer remains responsible for charges incurred before suspension or termination.
- If nonpayment occurs repeatedly, Company may charge the credit card on file after each service rather than billing monthly.
- For property management accounts, the property management company is the responsible billing party, regardless of whether it separately charges or collects payment from individual property owners.
- Property management accounts may be approved for invoiced billing in place of a card on file. Invoiced accounts are invoiced on the 1st and 15th of each month for the pickups and charges since the previous invoice, with payment due within 14 days of the invoice date. Service may be suspended for nonpayment.
8. Scheduling, Changes & Cancellations
Scheduled services may be coordinated through reservation calendars, property management schedules, or direct requests.
Customer agrees to provide accurate reservation and checkout information.
Changes to checkout dates or pickup requirements should be communicated as soon as possible and no later than 24 hours before the scheduled pickup time.
Company will make reasonable efforts to accommodate schedule changes, subject to availability.
Scheduled pickups occur on the scheduled day. The time of day is not guaranteed unless specifically agreed upon.
Same-day or additional pickup requests are subject to availability and applicable pricing.
A guest staying at the property may order one additional mid-stay pickup through the QR placard Company places at the property. The guest pays Company directly at the time of the order, at the flat rate shown at checkout. A guest-ordered pickup is not added to Customer's invoice and does not affect Customer's billing.
Company may reschedule service due to severe weather, road closures, emergencies, or other circumstances beyond its reasonable control.
9. Prohibited Waste
The following items are not accepted as part of standard trash pickup:
- Hazardous chemicals, pesticides, fuels, or flammable liquids.
- Paints, solvents, or other regulated waste.
- Medical waste, needles, or sharps.
- Hot ashes, burning materials, or hot coals.
- Construction materials or demolition debris.
- Large furniture, appliances, or bulky items.
- Uncontained broken glass or sharp objects.
- Any material prohibited by applicable disposal facility rules or law.
Customer is responsible for ensuring all waste presented for collection is appropriate for standard household trash disposal.
10. Liability & Property Damage
Trash Dash will exercise reasonable care when entering properties, handling trash, and performing services.
However, to the fullest extent permitted by applicable law, Company is not responsible for:
- Preexisting damage or unsafe property conditions.
- Accidents or injuries resulting from conditions not caused by Company.
- Wildlife-related damage, scattered garbage, or unsecured trash.
- Delays caused by weather, road conditions, blocked access, or circumstances outside Company's reasonable control.
- Consequential losses, including missed turnovers, guest complaints, refunds, or lost rental income, arising from service delays or unsuccessful pickups.
Company is not responsible for damage caused by improper trash preparation, overloaded bags, leaking containers, or hazardous materials supplied by Customer, except to the extent caused by Company's own negligence or misconduct.
Nothing in this Agreement excludes liability that cannot lawfully be excluded under New Mexico law.
11. Customer Responsibilities
Customer agrees to:
- Provide accurate property and access information.
- Ensure trash is properly bagged and secured and provide guests with clear, accurate, and specific trash-disposal instructions.
- Maintain safe and accessible driveways, walkways, and collection areas.
- Keep the designated collection area accessible and usable.
- Communicate reservation changes affecting pickup schedules.
- Keep a valid credit card on file.
- Pay all agreed service fees and applicable additional charges.
- Obtain necessary permission for Company to enter the service property.
- Inform Company of known hazards, aggressive animals, or other relevant safety concerns.
12. Service Suspension & Termination
Either party may terminate ongoing service by providing written notice.
Customer gives written notice to end service for a property by text message to 575-376-5337 or by email to Cleanafnm@outlook.com. Service is ended by contacting Company; it cannot be ended through the website. Once notice is received, Company will stop scheduling pickups for the property.
Customer remains responsible for services performed and charges incurred before termination.
Company may suspend or terminate service for nonpayment, repeated access problems, unsafe conditions, prohibited waste, or violations of this Agreement.
Company may retrieve its materials from the designated collection area upon termination, and Customer agrees to provide reasonable access for retrieval.
Outstanding charges will be included in the final invoice.
Termination does not eliminate outstanding payment obligations.
13. Changes to Service Terms
Company may update service procedures, pricing, or these Terms of Service by providing at least 30 days' written notice.
Changes will apply prospectively. Customer may terminate service before the effective date of a material change.
14. Governing Law
This Agreement will be governed by the laws of the State of New Mexico.
15. Customer Acknowledgment & Acceptance
Customer specifically acknowledges:
- The six-bag allowance per scheduled pickup, and that repeated overages may require a revised service plan or adjusted pricing.
- The $10.00 unsuccessful pickup fee for inaccessible or unsafe properties, or when no trash is present at the designated collection area.
- Responsibility for maintaining safe winter access.
- Wildlife and scattered-trash exclusions.
- The requirement to maintain a valid credit card on file, except that property management accounts approved for invoiced billing are invoiced instead, with payment due within 14 days of the invoice date, and service may be suspended for nonpayment.
- The one-time setup and verification fee charged at signup.
- Monthly billing, issued at the beginning of each month for the prior month's services (property management accounts approved for invoiced billing are invoiced on the 1st and 15th).
- That materials placed by Company at the designated collection area remain Company property and may be retrieved upon termination.
By accepting this Agreement, Customer acknowledges that Customer has read, understands, and agrees to the Trash Dash by Clean AF Terms of Service.
